Non-U.S. citizen children traveling to the U.S.

All children, including infants, must have their own travel documents, such as a passport or visa to enter the U.S.

Additionally, if the child is traveling alone, with only one of their custodial parents, or with a guardian to the U.S., they should have:

• Each country has its own rules for the specific documents it requires for a child to be allowed to leave their home country without both of their custodial parents or with a guardian. Contact the embassy or consulate of the country the child is a citizen of to find out what specific documents the country requires to allow the child to leave their country.
• The letter should say: "I acknowledge that my child is traveling outside the country with [the name of the adult] with my permission."
• A parent who frequently crosses the border by land with a minor should always carry a letter of permission from the other parent.
• A parent with sole custody of the child they are traveling with should carry a copy of the custody document.

If your child is traveling alone by air, the airline may require you to submit an unaccompanied minor form and pay a fee for unaccompanied minor service. Private security information (APIS)

Countries require visitors to provide personal information known as Advanced Passenger Information (API) or Advanced Passenger Information System (APIS). This information must be collected by the airline before the passenger boards the flight.

You will need to provide this information during the reservation process to ensure that you can use other self-service check-in options.

According to new regulations, children are no longer permitted to travel on a parent’s passport. Your children must have their own passports and visas.

Important notices

• Check your passport for any damage. Make sure that the passport book is not completely or partially detached from its container, and that the plastic sheet on the photo page is not separated or torn.
• Make sure that there is a blank page in your passport for the entry-exit stamp of your international travels.
• Passport, ID and ticket information in travel documents must be the same. For name changes, it is necessary to renew the passport or submit the official letter (marriage certificate, divorce decree, etc.) to the officer during the trip.
• If your valid visa is in an old passport (expired, no blank pages, old-style passport, etc.), you should contact the consulate of the country you are traveling to.
• Since the validity period of the passport differs according to the country of travel, make sure that the validity period of your passport is sufficient and that your passport is not damaged (torn, scraped, erased, etc.). In addition, the signature box must be signed by the passenger.
• If you have a connecting flight, please review the visa regulations for the transit country, including whether an airport transit visa is required and the exemption conditions for visa-free transit.
• Some Arab countries cannot be entered if there is a valid or invalid Israeli visa or entry-exit stamp in the passport.
• You can also travel to Ukraine, Moldova, Georgia, Azerbaijan and the Turkish Republic of Northern Cyprus with your new Turkish ID card without passport. Child passengers must also have a new type Turkish ID card with a photo. Temporary Ids are not valid to travel to these countries.

Get permission to take a child abroad

You must get the permission of everyone with parental responsibility for a child or from a court before taking the child abroad.

Taking a child abroad without permission is child abduction .

You automatically have parental responsibility if you’re the child’s mother, but you still need the permission of anyone else with parental responsibility before you take the child abroad.

You can take a child abroad for 28 days without getting permission if a child arrangement order says the child must live with you, unless a court order says you can’t.

Get permission from someone with parental responsibility

A letter from the person with parental responsibility for the child is usually enough to show you’ve got permission to take them abroad.

You might be asked for the letter at a UK or foreign border, or if there’s a dispute about taking a child abroad. The letter should include the other person’s contact details and details about the trip.

It also helps if you’ve:

• evidence of your relationship with the child, eg a birth or adoption certificate
• a divorce or marriage certificate, if you are a single parent but your family name is different from the child’s

Get permission from a court

You’ll need to apply to a court for permission to take a child abroad if you haven’t got permission from the other people with parental responsibility.

You must give details of the trip, eg the date of departure, when and how you’re returning, and contact details of people with parental responsibility staying in the UK.

You must give more information if you’re taking the child abroad for a longer trip, eg what education the child will get while they’re abroad.

You need to contact the embassy or consular office of the country you are travelling to for information about the age limit up to which a person is considered a child.

This is to ensure that the child’s travel is not impeded by legal requirements and that the child is protected from any potential harm or danger. The written consent should include important details such as the child’s name, dates of travel, destination, and the name of the accompanying adult or adults. It is highly recommended that parents consult with the relevant embassy or consulate to determine the specific requirements for parental travel consent in their destination country.

What Are The Typical Circumstances That Require Travel Consent?

Before children travel to another country, they may need to fulfil certain requirements set by the immigration officials of that country, which may include undergoing a process overseen by a notary public. As a rule, a notarised parental letter of consent to travel abroad is required in the following situations:

• When a child is crossing the border with only one parent, especially if the child’s surname differs from that of the accompanying parent.
• When the child is crossing the border without either parent, they may be accompanied by friends, family members, or trusted adults as their guardians.

The written travel consent authorization is a legal document that plays a pivotal role in safeguarding children’s welfare by reducing the risk of child abductions when travelling outside of the country. This prevents the minor from being taken away without the permission of their absent parent(s) and ensures their safe return.

Immigration authorities may have reservations if they suspect a child is being taken to a destination without the knowledge or approval of one or both their parents. The travelling party may be detained at the airport until clarification is obtained, which can cause significant frustration and stress for everyone involved.

The process of consularising a document may take a considerable amount of time, especially if the relevant country requires it to be done by the UK Embassy. Which Countries Mandate Written Parent Consent For Travel?

Currently, there are several countries, such as Portugal, Italy, Russia, Brazil, Australia, Thailand, South Africa, and Ukraine, which require parental permission for a child to travel abroad.

The reason for this is the increasing worry and alarm regarding the abduction and trafficking of children, which has become a pressing issue in our society. As a result, it is likely that more countries will adopt such requirements in the future as a preventive measure to ensure the safety and protection of minors.

It can be challenging to obtain a clear response from the Embassy on this matter. However, at our legal agency in London, we have seen many instances where parents were unaware of the need for a consent form for minors to travel. As a result, they experienced strong emotional distress, missed flights, and ultimately were unable to attend important family events or even return to their home country. To avoid confusion or stress, it is advisable to obtain written consent for travelling if there is any uncertainty.

How to Prepare a Parental Letter of Consent to Travel

To complete the process, the notary public should meet with both parents if possible. However, there is a requirement to meet with the parent who is not travelling at a minimum. It is necessary for the authority to review the original documents listed below.

• The parents’ government-issued identification documents such as passports.
• The child’s government-issued identification document such as a passport.
• The official documents containing information about the children’s birth.
• The government-issued identification documents such as passports of any accompanying adults, if applicable.

After meeting with the parents, the notary can prepare the necessary travel consent documents for the absent parent(s) to sign. After notarizing the document, they will send it for consularisation if needed. It is recommended to allocate enough time for this process, as it may take up to a week or more if consularisation is necessary. The papers can be prepared within 24 hours, but it depends on the workload of the notary.

Can I Take My Child Abroad Without a Parent’s Consent

In the United Kingdom, both parents’ written consent must be obtained if they have parental responsibility, before taking the child abroad. Failure to do so may result in accusations of child abduction, a serious criminal offense. However, if there is a court order that permits one parent to take the child abroad, the other parent’s consent is not required.

Is an institution the legal guardian of the child? Then permission is needed from the institution. The institution can draw up a letter stating that there is permission for traveling abroad.

Children under the age of 18 are always under the parental authority of one or both parents or under the guardianship of someone other than the parents. Is the child under the age of 18? Fill in this scheme again or contact us. When the child turns 18, the parental authority or guardianship automatically ends. For children aged 18 years or older, permission is no longer needed.

Do both parents have parental authority over the child?

If both parents have parental authority, this is called joint parental authority. If only one parent has parental authority, this is called sole parental authority. More information about parental authority

Do both parents with parental authority travel with the child?

If both parents with parental authority travel with the child, the authorisation form is not needed. At the Dutch border control, parents might be asked to demonstrate that they are the actual parents of the child. Parents can use an (international) birth certificate or an (international) extract from the Personal Records Database (Basisregistratie Personen - BRP) of the child.

Does one of the parents with parental authority travel alone with the child?

Does one of the parents with parental authority travel alone with the child? And is there joint parental authority? Then permission is needed from the parent who is staying behind. We recommend bringing these documents:

• authorisation form, signed by the parent who is staying behind;
• copy of the passport, ID card or driver's license of the parent who is staying behind;
• (recent) extract from the Personal Records Database (Basisregistratie Personen - BRP), including details about the child's parents and the parental authority.

Instead of the extract BRP, it is also possible to bring an (international) birth certificate.

Does the child travel alone or with friends or family? And is there joint parental authority? Then permission is needed from both parents who are staying behind. We recommend bringing these documents:

• authorisation form, signed by both parents;
• copy of the passport, ID card or driver's license of both parents;

Does only one parent have parental authority over the child?

Does the parent automatically have sole parental authority over the child?

According to Dutch law, the mother who gave birth to the child automatically has parental authority. This is not the same for the other parent. If the parents are not married or are not registered partners, the other parent has to recognize the child and apply for joint parental authority. If this has not happened, the mother automatically has sole parental authority. More information about parental authority

Has the other parent recognized the child, but does he or she not have parental authority?

If the other parent recognizes the child, he or she becomes the legal parent of the child. A legal parent is mentioned on the birth certificate. A parent who recognizes the child, does not automatically obtain parental authority according to Dutch law. He or she needs to apply for this at the district court, digitally or in writing. The mother who gave birth to the child is automatically the legal parent and automatically has parental authority. A legal parent without parental authority cannot decide, for example, where the child lives, or if the child is allowed to move abroad.

Does the parent with sole parental authority travel together with the child? And has the other parent recognized the child? Then the authorisation form is not needed. Other advice

In some countries, such as South Africa, additional requirements apply for traveling with children. Check with the embassy or consulate  of the country you are traveling to if there are additional requirements for traveling with children.

If you travel by plane, make sure to get to the airport in time. If extra time is needed to look at your documents at the Dutch border control, you have time to do so without risking to miss your flight.

Ask if the parent who gives permission wants to make sure that he/she can be reached by phone during the trip. If the RNLM has questions, they can contact the parent by phone. This applies to both traveling in and out of the country, since foreign authorities may also ask if there is permission.
